The term “Knowledge Diffusion,” “we,” and “us” includes Knowledge Diffusion Inc. (also known as “Osmosis”) and our affiliates and subsidiaries. “Osmosis” means any website, mobile application, or Internet service under Knowledge Diffusion’s control, whether partial or otherwise, in connection with providing the services provided by Knowledge Diffusion, including osmose-it.com and freetext.org.

“Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number, as well as payment information. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual. We collect, retain and process Personal Information about Users (as defined below) in order to provide Osmosis and for the other purposes described in this Privacy Policy.

“User” means a person who uses services offered by Knowledge Diffusion through Osmosis. Users may be students who purchase and use Osmosis directly, or who have been provided access to Osmosis by one of our University Customers (as defined below).

“University Customer” means a customer who is an educational institution or universities and who purchase and use services offered by Knowledge Diffusion through Osmosis.

We have included several annotations in boxes to help explain or identify key sections. These annotations are for convenience only and have no legal or contractual effect.

OSMOSIS COLLECTS YOUR INFORMATION

We collect Personal Information when you:

register to use Osmosis;
log in with social networking credentials;
use Osmosis; and
communicate with us.

We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use Osmosis.

Personal Information Collection. You must register to use Osmosis. To register, you may need to provide Personal Information, such as your name, email address, gender, and social network log-in credentials. You may also provide other optional information.

Social Sign-On. We collect Personal Information from the social media website when you use your social media credentials to log into Osmosis or connect your Osmosis account to the social media website account. For example, when you log in with your Facebook credentials, we may collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture. We may also obtain other information with your permission, such as your Birthday, Groups, Institutional Affiliation, Graduation Year, Friend List, and Current City. You may also sign into your social media account to find friends who also use Osmosis.

Using Osmosis. We collect information you post through Osmosis. For example, when you interact with other users by posting comments or by updating your account information, Osmosis will collect the information you provide in such submissions, including any Personal Information.

Location Information from Your Mobile Device. We may collect and store your location information if you enable your mobile device to send it to us. Collection of this information may improve the provision of Osmosis.

Customer Support. We may collect Personal Information through your communications with our customer-support team.

Cookies, Automatic Data Collection, and Related Technologies. Osmosis collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics.

When you visit Osmosis, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, Osmosis may not work properly.

By using Osmosis, you are authorizing us to gather, parse, and retain data related to the provision of Osmosis. We store your Personal Information for as long as is necessary to provide Osmosis to you and as long as you have an account on Osmosis.

We may also send email and text messages to you when you choose to receive Knowledge Diffusion Content (as defined in the Terms of Use) in this format.

Aggregate Data. We may anonymize and aggregate data collected through Osmosis and use it for any purpose, including for educational research and development and marketing purposes..

WE MAY DISCLOSE YOUR INFORMATION

with our third-party service providers as necessary for the provision of Osmosis;
to comply with legal obligations;
to protect and defend our rights and property; and
with your permission.

We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of Osmosis.

Displaying to Other Users. The content you post to Osmosis may be displayed on Osmosis. Other users of Osmosis, including Knowledge Diffusion-approved research and educational institutions, may be able to see some information about you, such as your name, information in the comments you post, and aggregate information about your question responses. We may provide you with privacy settings to control where Personal Information is displayed on Osmosis. We are not responsible for privacy practices of the other users who will view and use the posted information.

Social Networking and Other Websites. Osmosis may allow you to share information, including Personal Information, with social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct Osmosis to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

Marketing. We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect yours’, ours’ or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of Knowledge Diffusion assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information.

We may also disclose your Personal Information with your permission.

Within a reasonable time after you terminate your account, your Personal Information will be deleted and will no longer be stored by Knowledge Diffusion. Knowledge Diffusion may continue to use aggregated information from your account in the manner described in this policy and in the Terms even after your account has been cancelled.

SECURITY OF YOUR INFORMATION

We take steps designed to secure your information from unauthorized access or use. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using Osmosis or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of Osmosis.

CHANGING THE USE OF INFORMATION

You can let us know if you do not want us to send you information by taking the following steps:

SPECIAL NOTICE TO CALIFORNIA RESIDENTS

If you are a User who purchases and uses Osmosis directly, we serve as the “controller” of the personal data you provide to us. If you are a User who has been provided access to Osmosis through one of our University Customers, we process your personal data on behalf of our University Customers to fulfill our contractual obligations to them, in which case we serve as a “processor” of your personal data and the University Customer providing you access to Osmosis acts as the “controller.”

If you are using Osmosis from the European Union, we will only transfer your Personal Information to the United States through the use of appropriate safeguards such as standard contractual clauses adopted by the European Commission or with your consent. If the transfer of your Personal Information or processing of your Personal Information is based on your consent, you may contact us at [email protected] to withdraw your consent. If you withdraw your consent we will not be able to provide you with access to Osmosis.

We process personal data as necessary to pursue our legitimate interest of providing Osmosis to both Users and University Customers and to fulfill our contractual obligations. You have the right to access your personal data, correct inaccuracies in your personal data, request the erasure of your personal data and restrict the processing of your personal data.
